Introduction
Thank you for choosing East Windsor for your development project. This guide has been prepared to help guide you through the town’s land development approval process. It provides a concise but complete overview of the process including application requirements, review sequences and timing. The guide includes both mandated and optional procedures guiding actions the applicant may wish to pursue.
This guide is not a legal document. It is to be used in conjunction with the town’s Zoning Regulations, Wetlands Regulations, Plan of Conservation and Development, and the Manual of Technical Design and Policy. The regulations are the final authority governing land use and development. The developer is encouraged to obtain a copies of the applicable documents from the Town Planner and refer to them once you have an overall understanding of the basic requirements as outlined herein.
The guide is divided into seven sections:
1. Town Departments gives you a synopsis of the part played by each department in the development approval process.
2. Commissions explains the purpose of each commission and how it may effect your application.
3. Approval Process Flowchart and Timeline is a flowchart that enables you to review the approval process in its entirety and serve as a map for you to follow. (Not included with PDF version)
4. Fee Schedule lists the fees you may be required to pay during the approval process.

The timelines on page f-1 through f-5 represents estimates based on experience the town has had with similar projects. Your time to complete each task may vary depending on the complexity of your project and amount of information required by town staff. Remember that not all approvals may be necessary for a particular project. Each developer is encouraged to begin the development approval process by first meeting with the Town Planner.
This guide intentionally does not cover the approval process for residential subdivisions, re-subdivisions and single family residential projects. For a copy of the flowchart detailing the approval process for these projects see the Town Planner.
Town Departments
Planning and Development
It is very important to discuss your project with the Town Planner before a proposal goes beyond the conception stage. The Town Planner can provide the developer with valuable information about the approval process, zoning and subdivision regulations, and specific projects design factors. In addition, the Town Planner can coordinate predevelopment reviews with the developer and other Town agencies.
The Planning and Development Department administrates and coordinates all land use applications related the Planning and Zoning Commission and the Zoning Board of Appeals. These applications include site plans, special permits, subdivision/re-subdivision, variances, and site location approvals. In addition, the department is also responsible for zoning permits and the enforcement of the zoning and subdivision regulations.
The Town Planner is the administrative agent to the Planning and Zoning Commission and functions as liaison between the Commission and the applicant. The Zoning Enforcement Official administers both the zoning permit process and the enforcement of the zoning regulations.

Engineering
If your project involves the extension of public utilities such as sewer, water, storm drainage or roadways, the Town Engineer may become involved. Construction activities that may also impact existing infrastructure may also need to be reviewed by the Town Engineer. Issues such as sight lines evaluation and improvements for new driveways and roads, storm drainage impacts, construction details and specifications may be required to properly evaluate a proposal. Additionally, the Town Engineer provides input on projects referred to Planning and Zoning, Wetlands, and the Health Department as requested.
Plans should be submitted to the applicable agency and then forwarded by the agency to the Town Engineer.

Inland Wetlands Watercourse Agency
Contact Nancy Rudek, ZEO/Welands Agent in the Planning and Development Department to determine if wetlands or watercourses are within the 150 foot regulated area of any proposed activity. If the proposed project involves a regulated activity requiring a permit, an application must be submitted and reviewed by the Inland Wetland Commission. The Wetland Agent will provide information regarding timeframes for submittal of applications.

Public Safety
During the initial review process for commercial and industrial developments, the Police Chief and Fire Marshal will review plans for issues related to site access, circulation, traffic safety, provisions for fire lanes, building height, and location of fire hydrants. Comments and recommendations will be provided to the applicant and the Commission. Applicants should consider these issues when designing the site.
Fire Marshal: East Windsor has two fire districts, Broad Brook and Warehouse Point. Most of the Town’s commercial and industrial zoned land is in the Warehouse Point section of Town and has adequate public water supply for fire suppression. Limited water service is available in the Brood Brook area. Applicants should contact the appropriate Fire Marshal to discuss concerns related to fire safety.
Police Chief: The Police Chief and Police Department function as the agents for the Town of East Windsor Traffic Authority. Applicants for projects that may have traffic concerns or impacts on any Town roads should contact the Police Chief for information and input on traffic related concerns.

North Central District Health Department
The North Central Health Department is charged with the responsibility of safeguarding the public health and implementing the provisions of the state public health code and local sanitary codes related to food handling, septic systems, potable water quality, environmental health and other related activities. If your project involves expansion of an existing structure or a new structure, change of use, or any type of food service, you will need to review the proposal with the Health District. Septic system evaluations, soil testing, plan review and inspection may or may not be required, depending on the nature of the proposal.

East Windsor Water Pollution Control Authority
The WPCA is the agency within the Town that oversees, regulates, and administers the operation of the Town’s sanitary sewer system. Any proposal that involves the extension of or a connection to the sewer system, or change of use requiring a permit under the building or zoning regulations must apply to and receive WPCA approval.
Summary of WPCA Application Process (also see Approval Process Flow Chart on page f1)
Applicant provides completed application, application fee, any necessary plans and specifications, including projected flow data to the WPCA.
Completed application and supporting data is forwarded to the WPCA engineer for technical review and a determination of the accuracy of the projected flow data.
Once satisfied that the application meets the WPCA construction guidelines, the engineer issues a letter stating that to the WPCA.
The applicant is expected to attend the next WPCA meeting and make a brief presentation describing his project and to answer any question the WPCA may have.
Following discussion, the applicant can expect to receive WPCA approval of his project.
Once approved, the applicant’s contractor must contact the WPCA and arrange to provide insurance and bonding requirements.
Contractor must contact WPCA to arrange for inspection in advance of commencing construction.
Applicant / Contractor must provide an “as built” drawing prior to receiving WPCA signature on building department routing sheet.

Building
The Building Department answers questions regarding building codes, life safety codes and construction concerns. The staff is responsible for the following:
1. Guiding individuals through the application process including referrals for various agencies.
2. Accepting plans for both fire marshals for referral to each office.
3. Conducting construction plan reviews and inspecting all work during construction.
4. Issuance of building and mechanical permits; as well as, Certificate of Occupancies.
5. Assisting the public with code related questions and consulting with architects and engineers on larger scale projects.
6. Overseeing all Town owned projects for compliance with building, plumbing, electrical and mechanical codes.
Each permit application is reviewed in plan format prior to permit issuance to verify code compliance. Plans are reviewed with regard to structural, electrical, plumbing and mechanical codes as necessary. This review is conducted in conjunction with the Fire Marshal, Water Pollution Control Authority, North Central Health Department, the Zoning Office and any other agencies deemed necessary to ascertain that a permit is issued with all proper approvals. Please call ahead for advice in regards to the permit process and necessary paperwork.
Building Permit Process (also see Approval Process Flow Chart on page f1)
When an applicant comes in to apply for a permit for a commercial or industrial project, the staff will make an evaluation of the project and decide on the agencies that will need to be contacted for approvals prior to issuance of the permit.
The applicant is given an application to fill out and submits two sets of plans to be reviewed by the Building Department for approval.
The applicant also leaves one set of plans for the appropriate fire marshal with a referral sheet for approval. The Building Department disperses the plans accordingly.
The applicant is instructed to make application with the Zoning Office for a Zoning Permit, which must be received by the Building Department prior to issuance of a permit.
The applicant is given a referral sheet to bring to W.P.C.A. for approval, to be returned to the Building Department prior to issuance of permit.
If the project involves the N.C.H.D., the applicant is instructed to contact the N.C.H.D. for an approval to be returned to the Building Department prior to issuance of permit.
If the project involved a curb cut on a State road, the applicant is instructed to contact the D.O.T. to obtain the proper permits. When this has been accomplished, a copy of the permit must be submitted to the Building Department prior to issuance of permit.
The time frame from the time of application submittal to the issuance of a permit varies with each project. Depending on which agencies are involved. Some projects may clear everyone within a month from time of submittal and others could go several months. If the applicant did some prep work ahead of time with the agencies involved then approvals can come quicker.
Building Permit Fees
The basic fee for building, electrical, plumbing, mechanical permits is $20.16 for the first $1,000.00 of proposed construction cost thereafter; provided, however, that, no fee shall be less than $20.16. All such fees shall be paid to the Building Department.
Sign permits are $15.00 plus $.35 per square foot of sign area. For a double-faced sign, count the square footage area of both. Plus, add $.16 per thousand on estimated cost of construction of sign for the State of Connecticut.
Wood/coal/gas stove permits are a flat rate of $10.00.

Commissions
Planning and Zoning
This commission receives and decides on proposals for site plan, special permit, and subdivision approvals.
Site Plan: An administrative review is performed by the Commission to ensure that the proposed development conforms to specific provisions of the Zoning Regulations. All commercial and industrial developments require site plan approval.
Special Permit: An administrative review is conducted by the Commission for a special type of zoning permit that requires the application for specified uses, to meet specific standards and/or safeguards specified by the Zoning Regulations for that use. All Special Permit applications require a public hearing and include site plan approval.
Subdivision: An administrative approval by the Commission for the division of land, as defined by Statute. The Commission requires public hearing for both subdivision and re-subdivision applications.
The Planning and Zoning Commission conducts public hearings on development proposals, as required, at which time comments by the applicant, town staff and the general public are received. They also draft zoning and subdivision regulation amendments, and periodically update the Plan of Conservation & Development. Applicant should consider the policies and recommendation of the Plan of Conservation & Development when proposing a project.

Conservation Commission – Inland Wetland Watercourse Agency
The Inland Wetlands and Watercourses Regulations requires an Inland Wetlands Permit for:
1. Any activity within wetlands or watercourses
2. Any activity within the 150 foot regulated buffer area around wetlands and watercourses
3. Construction activity which will impact a wetland or watercourse
The Inland Wetlands Commission examines proposals for their impact on wetlands and watercourses. The most important thing that the Commission will be looking at is the potential for destruction of wetlands by filling or erosion. They also look at the degrading influences caused by runoff from lawns, driveways and storm water discharge. Any proposal should attempt to minimize the effects on wetlands and watercourses. Applicants should talk with the Wetlands Agent for help in filling out the application and for suggestions on minimizing the time required for approval.

Zoning Board of Appeals
The Zoning Board of Appeals (“ZBA”) has three major functions that may relate to the land use approval process. Before preparing a ZBA application, please make sure that your issue falls within one of the following situations:
Appeals: The ZBA will hear and decide on any appeal where it is alleged that there is an error in the order, requirements, or decision of the Zoning Official as related to the zoning regulations.
Variances: The ZBA will hear decide, on a case by case basis, applications to vary specific sections of the Zoning Regulations, where applicant can't meet the requirements of zoning due to unique conditions of the property (unusual size, shape, locations or topography). The applicant must prove unusual hardship to the property and it can not be financial in nature, self-imposed, or personal.
Site Location Approval: The ZBA will hear and decide on all requests for certificates of approvals for new and used motor vehicle sales, service and repair, and gasoline stations.
When hearing appeals of a decision or an application for variance, the Zoning Board of Appeals acts under its zoning authority in a quasi-judicial capacity. When hearing applications for Site Location Approval, the ZBA acts as an administrative agency of the State and not under its zoning authority.
Applications for the Zoning Board of Appeals are available in the Planning and Zoning Department. It is recommended that you consult with the Zoning Official before submitting applications to the ZBA.

Economic Development Commission
The purpose of the Economic Development Commission is to promote commercial development in East Windsor. This is accomplished by working with property owners and existing businesses, and civic organizations as well as potential developers and businesses interested in locating in East Windsor. The EDC promotes the reuse of existing facilities and the development of new commercial projects that meet the needs of the development community, the Town and region.
Due to limited staff and resources the First Selectman's Office and the Town Planner act as EDC staff and contact points. Potential developers, new businesses, and existing businesses interested in East Windsor should contact the First Selectman or Town Planner for assistance with development projects and the approvals process.

(1) A minimum of one inspection for both E & S and Bonds shall be paid for with the Zoning Permit application. Additional inspection fees shall be paid prior to the issuance of a "Certificate of Occupancy."
(2) Public facilities include the following: sanitary sewer, storm drainage systems including yard drains and detention basins proposed to be turned to over the Town.
(3) Word processing fee may be waived if approved changes are provided, properly formatted, on disk in current MS Word format.
Proposed Impervious Surface: Means any new impervious surfaces to be constructed on a site and shall include proposed additions or new construction that may cover existing impervious surfaces.
Amendments
Applications for amendments to any plan approved less than one year prior to application for the amendment shall be charged at 100% of the above base fee. The fee for any new or modified area shall be charged at the fee per square foot indicated above.
Applications for amendments to any plan approved greater than one year prior to application for the amendment shall be charged at 100% of the above base fee. The fee for any new or modified area shall be charged at the fee per square foot indicated above.
Inspections
Site inspections for bond reductions shall be conducted when requested by the applicant and shall be chargeable at the above fee(s) per staff person in attendance.
Site inspection for erosion and sedimentation control shall be conducted when requested by the applicant or the Town Planner, Zoning Enforcement Officer or Town Engineer. Such inspections shall be chargeable at the above fee(s) per staff person in attendance, except that if an inspection is initiated by town staff without the request or consent of the applicant, and it is found that no remedial action is necessary, the applicant shall not be charged.
Payment of Fees
All application fees must be paid in full before an application will be accepted. Subdivision road review shall be part of the application fee. No Zoning Certificate of Occupancy or Building Certificate of Occupancy shall be delivered to the applicant until all inspection fees are paid in full.

Exemption: Boards, Commissions, Councils and Departments of the Town of East Windsor are exempt from all fee requirements.
Waiver: The applicant may petition the Agency to waive or reduce payment of the fee during the application period. Such petitions shall be in writing and shall state fully the facts and circumstances the Agency should consider in its determination under this subsection. The Agency may waive all or part of the application fee if the Agency determines that:

a. The activity applied for would clearly result in a substantial public benefit to the environment or to the public health and safety and the applicant would reasonably be deterred from initiating the activity solely or primarily as a result of the amount of the application fee, or
b. The amount of the application fee is clearly excessive in relation to the cost to the Town for reviewing and processing the application.
The Agency shall state upon its record the basis for all actions under this subsection.
Method of Payment: All fees required by these regulations shall be submitted to the Agency by certified check or money order payable to: Town of East Windsor at the time the application is received with the Agency.
No application shall be granted or approved by the Agency unless the correct application fee is paid in full or unless a waiver has been granted by the Agency.
The application fee is not refundable.
Definitions. As used in this section: “Residential Uses” means activities carried out on property developed for permanent housing.
NOTE. The Connecticut State Legislature, under Public Act 92-235, requires that the Town of East Windsor collect an additional $10.00 for every land use application that is processed. This fee is in addition to the fees charged by the Town.
