TOWN OF EAST WINDSOR
The following ordinance was adopted at a Special Town Meeting duly warned and held on February 24, 2010.
“ORDINANCE CONCERNING THE REMOVAL OF ICE AND SNOW FROM SIDEWALKS IN THE TOWN OF EAST WINDSOR”
Section 1. The owner, tenant or occupant of any building or land adjoining and/or fronting upon any concrete or paved sidewalk shall cause to be removed from such sidewalk any and all snow and sleet, to a width of thirty-six (36) inches, within twenty-four (24) hours after the same shall have fallen during the night; and whenever such sidewalk or any part thereof shall be covered with ice, the owner, tenant or occupant of the building or land adjacent thereto, shall, within twenty-four (24) hours thereafter during the daytime cause such sidewalk to be made safe by removing the ice there from or by covering the same with sand or some other suitable substance.
Section 2. The owner, tenant or occupant of any building or land whose duty it is to clear the sidewalks adjacent thereto, who shall violate any of the provisions of the foregoing section, or refuse or neglect to comply with the same, shall be guilty of an infraction and shall pay a fine of Fifty Dollars ($50.00). Said fine shall be paid within 7 days of being invoiced by the Town of East Windsor. Each day of non-compliance shall be deemed a separate violation.
Section 3. The Selectmen, in accordance with the powers conferred upon them by Section 7-148 of the General Statutes, may upon the failure, default or neglect of the owner, tenant or occupant of such adjoining and/or fronting premises to comply with Section 1 of this Ordinance, remove any snow, sleet or ice from any such sidewalk and invoice the owner for the cost of said removal. Failure to pay said invoice within 7 days shall cause a certificate of lien for the expense thereof, and any and all applicable fines, to be recorded in the Town Clerk’s Office within sixty (60) days from the date of such removal.
Section 4. Pursuant to Section 7-163a of the Connecticut General Statutes and notwithstanding the provisions of Section 13a-149 of the Connecticut General Statutes or any other general statute or special act, the Town of East Windsor shall not be liable to any person injured in person or property caused by the presence of ice or snow on a public sidewalk unless the Town of East Windsor is the owner or person in possession and control of land abutting such sidewalk, other than land used as a highway or street, provided the Town of East Windsor shall be liable for its affirmative acts with respect to such sidewalk.
EFFECTIVE DATE: The provisions of this ordinance shall become effective fifteen (15) after acceptance at a properly called Town Meeting for its adoption and after publication in accordance with law.
