TOWN OF EAST WINDSOR
The following ordinance was adopted at a Special Town Meeting duly warned and held on March 6, 1997. Said ordinance shall become effective fifteen (15) days from the publication thereof.
TO AMEND AN ORDINANCE ENTITLED
ORDINANCE FOR CREATING A CAPITAL NON-RECURRING EXPENSE FUND
EXPRESSLY FOR MONIES RECEIVED BY THE PLANNING AND ZONING
COMMISSION IN LIEU OF OPEN SPACE DONATIONS FROM DEVELOPERS
BE IT ENACTED:
The Town of East Windsor shall, according to the Provision of Chapter 108, Sections 8-25 and 8-25b of the Connecticut General Statutes, establish a Capital Non-recurring Expense Fund for the purpose of receiving all monies paid to the Planning and Zoning Commission in lieu of open space donations by developers.
Said funds are to be handled by the Town Treasurer as per Section 7-359 through 7-368, Connecticut General Statutes.
USE OF FUND:
Said funds shall be used for the purpose of preserving open space or acquiring additional land for open space or recreational purposes. As recommended by the Park & Recreation Commission, and approved by the Planning & Zoning Commission, Board of Selectmen, Board of Finance and the Town Meeting.
